These Terms of Service ("Terms") govern your use of the SC Express website and your purchase of shipping containers from SC Express, operated by WM LLC, located at 920 N Canyon St, Hildale, UT 84784.

1. Products and Pricing

All shipping container prices displayed on our website are subject to change without notice based on market conditions and availability. Displayed prices do not include delivery or applicable state and local taxes unless explicitly stated as "delivered price." Delivered pricing is an estimate based on mileage calculations and is subject to final confirmation.

2. Container Condition

SC Express grades all containers honestly using industry-standard designations: One-Trip, Cargo Worthy (CW), Wind & Water Tight (WWT), and As-Is. Grade descriptions are provided for informational purposes. While we make every effort to accurately represent container condition, used containers may have cosmetic imperfections not captured in photos or descriptions. As-Is containers are sold without any warranty or guarantee regarding condition, water tightness, or structural integrity.

3. Delivery

Delivery timelines are estimates and not guarantees. SC Express is not liable for delays caused by weather, carrier availability, road conditions, or other factors outside our control. The customer is responsible for ensuring the delivery site is accessible and prepared per our delivery guidelines. SC Express is not responsible for damage to private property, driveways, landscaping, or underground utilities during delivery.

4. Payment

Payment is due in full before shipment for yard inventory purchased through our website. For quote-based purchases from suppliers and depots, payment terms will be communicated during the quote process. SC Express accepts major credit cards (3% processing fee applies), ACH transfers, bank wire ($20 transfer fee), cash, and check. A $500 deposit may be collected to hold a container, with the remaining balance due before or at delivery.

5. Refunds and Cancellations

Orders may be cancelled before the container has been loaded for transport at no charge. Once a container has been loaded or is in transit, cancellation fees may apply to cover transportation costs already incurred. Refund requests will be reviewed on a case-by-case basis.

6. SMS/Text Messaging Terms

By providing your phone number to SC Express — whether through our website, contact form, text message, phone call, or any other means — and consenting to receive text messages, you agree to the following SMS messaging terms:

Program Description: SC Express uses SMS and MMS messaging to communicate with customers about shipping container inquiries, price quotes, order confirmations, delivery updates, order status notifications, payment reminders, and responses to your questions. Our AI-powered assistant may respond to your messages automatically to provide faster service.

Message Frequency: Message frequency varies based on your interactions with us. You may receive multiple messages related to an active order or inquiry. We do not send unsolicited marketing texts.

Message and Data Rates: Message and data rates may apply. Your carrier's standard messaging rates apply to all SMS/MMS messages sent to and from SC Express. SC Express is not responsible for any charges from your wireless carrier.

Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message from SC Express. After opting out, you will receive one final confirmation message and no further texts will be sent unless you re-initiate contact.

Consent Not Required for Purchase: Consent to receive text messages is not required as a condition of purchasing any goods or services from SC Express. You may contact us by phone or email instead.

Supported Carriers: Major US carriers are supported including AT&T, T-Mobile, Verizon, Sprint, and others. SC Express is not liable for delayed or undelivered messages due to carrier issues.

7. Limitation of Liability

SC Express liability is limited to the purchase price of the container. We are not liable for indirect, incidental, or consequential damages arising from the purchase, delivery, or use of any shipping container. This includes but is not limited to property damage, lost profits, and business interruption.

8. Marketplace

SC Express provides a marketplace platform for third-party container listings. SC Express acts as an intermediary and does not own or inspect marketplace containers unless explicitly stated. Buyers and sellers use the marketplace at their own risk. SC Express reserves the right to remove listings, ban users, and withhold funds in cases of fraud or abuse.

9. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated revision date.
